New rights for tenants and new rules for landlords from 1 May 2026
Your tenancy will become an Assured Periodic Tenancy.
Tenancies will not have an end date. They will roll month by month.
Landlords can only increase rent using a Section 13 notice and must give 2 months’ notice to do this.
If you want to end the tenancy you must give 2 months’ notice in writing.
You can ask to keep a pet.
Your landlord must consider the request fairly.
Landlords must use a Section 8 Notice and list the grounds for possession if they need to evict you
Grounds for possession can be for:
- anti-social behaviour
- property damage
- non-engagement with your support
- or your landlord may want to sell the property
If you don’t leave at the end of the notice the landlord has to go to court.
The landlord will have to provide evidence to why they are evicting you.
You can go to court if you feel they don’t have a real reason to evict you.
You can access free legal advice through the Housing Loss Prevention Advice Service.
This service enables anyone at risk of losing their home to get free legal advice, and representation in court, regardless of their financial circumstances.
