Brighton & Hove Smoke Control Orders (Revocation) Order 2026
Brighton & Hove City Council under section 18 of the Clean Air Act 1993.
Notice in respect of the city of Brighton & Hove – Smoke Control Revocation Order 2026
Notice is hereby given that Brighton & Hove City Council (“the council”) of Hove Town Hall Norton Road Hove BN3 3BQ, proposes to make an Order, in the exercise of its powers under section 18 of the Clean Air Act 1993 (“the Act”) to:
Revoke previous Smoke Control Orders as listed in Schedule 1 insofar as they apply to the administrative area of the council.
The revocation of the existing Orders shall come into operation on a date at least 6 months after confirmation by Secretary of State, if confirmed by the Secretary of State, being a date not less than 6 months after the date of the decision.
The effect of this would be that, on any day after the proposed Order comes into operation, the regulatory controls relating to smoke control as set out in the Act will no longer apply.
The consultation will run from midday on 22 of June 12 midday until 6 July 12 midday. During this period hard copies of the proposed Order can be viewed at the reception desk at Hove Town Hall Monday to Friday between the hours of 9:30am to 4pm only.

Within the period 22 of June to 3 of August, any person who will be affected by the Order may raise an objection to the revocation of the Smoke Control Orders by giving notice in writing to DEFRA either by email at Air.Quality@defra.gov.uk or by post to the following address:
