About this privacy notice
The Council is the data controller for purposes of the Data Protection Act (2018) and The General Data Protection Regulation (EU) 2016/679 ("GDPR") and is registered as a data controller with the Information Commissioner’s Office (ICO)
Brighton & Hove City council are committed to protecting your personal information. As a data controller we have a responsibility to make sure you know why and how your personal information is being collected in accordance with relevant data protection law.
Why we are processing your data
We are collecting your data for the purpose of obtaining feedback to make improvements to the way we respond to hate incidents, informing our final Hate Incident Policy. We may also use your feedback to inform our Equalities Impact Assessment.
Our lawful basis for processing your data is performance of a task carried out in the public interest, GDPR Art.6 (1) (c) compliance with a legal obligation under S.3 Local Government Act 1999 and Housing Act 1985 Part II provision of housing accommodation – consultation with respect to management.
Our lawful basis for collecting special category data is substantial public interest under GDPR Art.9 (2) (g) and Data protection Act 2018 schedule 1 Part 2 (8) (1) equality of opportunity or treatment and under Section 1 (1) Equality Act 2010.
Who we will share your data with
Your data may be shared within Housing with teams such as Tenancy Management, Performance and Improvement, Housing Customer Services and the Community Engagement Team to make contact if you have opted to give further feedback on your experience of reporting hate incidents to the council. Your data will be anonymised and used to inform the final policy and Equalities Impact Assessment.
Your information will not be shared with any other third party unless we are under a legal obligation to do so.

How long we will hold your data (retention)
Your information will be kept for 6 years after which time it will be deleted
